Unibep SA confident in its position

We do not agree with the justification for the termination of the contract. We also believe that, for this reason, the termination is ineffective. We maintain that the reasons stated in the letter are unfounded and that Unibep SA exercised due diligence in preparing the design documentation in accordance with the contract, construction law, formal requirements, applicable standards and best professional practice,” said Andrzej Sterczyński, President of the Management Board of Unibep SA, commenting on the letter from the Military University of Technology in Warsaw regarding the termination of the contract for the investment titled “Construction of an educational building for the training of candidates for professional military service under a design & build contract.”
On 16 March 2026, Unibep SA received a letter containing the contracting authority’s notice of termination of the contract at the design stage for reasons which, in the opinion of the Military University of Technology, are attributable to the Company. At the same time, the contracting authority is seeking payment from Unibep SA of a contractual penalty of approx. PLN 15.6 million.
"In connection with this project, we have been in ongoing contact with the Military University of Technology for months. On many occasions, the contracting authority failed to respond to our queries or address issues raised by us that were justified by construction-related considerations and required clear and unambiguous determinations. I am all the more surprised by this situation given that, over the past few days, we have been engaged in discussions regarding the terms for continuing the contract, which also included clarifying the circumstances surrounding the termination. The other party clearly expressed its intention to continue the cooperation. It is regrettable that these discussions concluded unsuccessfully on 23 March this year." said Andrzej Sterczyński.
He further added that, in Unibep SA's opinion, the contracting authority’s termination of the contract is ineffective. Accordingly, the Company is not currently taking a position on any potential adverse financial consequences arising from the contracting authority’s notice, nor on the amount of any claims to which it may be entitled against the contracting authority.
It should be recalled that the matter concerns a project for which a contract was signed on 29 May 2025. The contract value amounts to approx. PLN 156.5 million. The project was scheduled to be completed within 1,000 days from the date of contract execution and is currently at the design stage.
It is worth noting that Unibep has previously completed and delivered the state-of-the-art Radio Science and Education Centre for the Military University of Technology and is currently constructing the Faculty of Cybernetics’ Centre for Innovation and Cybersecurity.
The Management Board of Unibep SA believes that further dialogue regarding the investment in question remains possible. “The continuation of the dialogue now depends on the authorities of the Military University of Technology,” pointed out Andrzej Sterczyński. “We value strong relationships with our clients, and I can assure you that we are drawing on our full expertise and capabilities to ensure that this project is delivered to the highest standard and is as functional as possible for the students and staff of the Military University of Technology.”
